This is the standard photo booth rental contract Inspirational Photo Booths uses that all rentals agree to, regardless of whether they are a paid event or a free event. The contract you sign in your client portal supersedes this contract and should be used for any questions regarding the terms of your rental.

This agreement (contract) made on [[todays_date]], between [[client_name]]  [Referred to as “Client” or “Party” or collectively as the “Parties”], and Chaney Inspirations LLC DBA Inspirational Photo Booths, a Texas corporation [Referred to as “Inspirational Photo Booths”, “us” or “we”] for photo booth services.

Contracted service may be referred to, but not limited to “event”, “gig”, “booth”, “service”, “proposal”, “project”.

  • Balance is due no later than 30 days prior to the event (price includes required taxes if in Texas, other states are responsible for remitting their own sales tax to the appropriate entity)

  • If the event is canceled, no portion of the fees paid to Inspirational Photo Booths will be returned
  • Any request for a date, time, or location change must be made in writing at least thirty (30) days in advance of the original event date

​ [[accept]] Access

  • Access to space must be available a minimum of two (2) hours before the requested start time. Inability to provide early access may delay our start and that time counts as part of your booth operation time.
  • Space must be at least 20’ by 20′ and 10’ in height, on a level surface, on solid ground, under a covering, and against a wall to protect the equipment from wind, rain, and poor lighting. 
  • The client is responsible for providing working power to the photo booth with 15ft. access to a working outlet (3 prong, 110V, 10 amps). If we are not near a working outlet, the client is responsible for ensuring no one trips on extension cords.
  • Events must be on the ground floor, or an elevator must be provided. Inspirational Photo Booths reserves the right to cancel and leave with no refunds if the condition is not met.
  • If the venue requires vendors to provide any insurance coverage documents, a written request must be received by Inspirational Photo Booths a minimum of five (5) business days (Monday through Friday, not including holidays) before the event.

  • Client is to provide:
    • Flat cart to transport booth and equipment
    • Minimum of 2 chairs
    • At least one table six (6) feet or longer
    • Bench or something guest may sit on when in booth

  • Inspirational Photo Booths personalized photo templates are customized for each client and may be revised up to two (2) times without incurring a design fee
  • Graphics such as logos or monograms, hashtags, or other items can be added if provided at least thirty (30) days before the event.
  • Client acknowledges they have the legal right and/or required license(s) to use any images, logos, or other materials provided. The client understands they can not just grab images from Google or any other website and use them as their own.
  • Client understands websites such as Etsy have sellers that sell items they do not have the right to sell and without proper licensing, regardless of source, can not be used. 
  • Client acknowledges printers may not work at all times and all packages are digital-only with a free print add-on that has no value, and therefore no refund can be given if prints become unavailable. Any size upgrades are output size upgrades only and not print upgrades.

  • Client must provide appropriate shelter, level surface, and power for outdoor events
  • Equipment and backgrounds can not be in direct sunlight. If equipment malfunctions as a result of the sun or environment, Inspirational Photo Booths reserves the right to cancel and leave with no refunds
  • If there is bad weather and appropriate safe space is not provided, Inspirational Photo Booths reserves the right to cancel and leave with no refunds
  • The environment must be pest-free
  • Smoking is prohibited in and around the photo booth area (applies regardless of location)
  • If the outside temperature is above 80 degrees Fahrenheit, equipment may not function properly, in which case the client must provide a cooler indoor space or Inspirational Photo Booths reserves the right to cancel and leave with no refunds.
  • Client provided generators are prohibited as power sources unless written approval is received in advance

[[accept]]​ Parking

  • Client shall provide parking for the Inspirational Photo Booths attendant’s vehicle while at the Client’s event. If parking is not provided, the Client agrees to have their card charged for the parking cost incurred.

​ [[accept]] Food

  • If food is provided at the event, the Client is required to make all courses, including desserts, available to attendants at no cost.
  • Unless otherwise noted, food must be available for up to 3 attendants.
  • If a choice is required to be made in advance, please notify Inspirational Photo Booths with options

​ [[accept]] Inherent Risk

  • An inherent risk of exposure to Coronavirus/COVID-19/Flu/Illness exists in any public place where people gather.
  • Inspirational Photo Booths can not be held liable for any claims of exposure at any events.
  • Masking/facial covering, testing, vaccination, or status of vaccination or test results of Inspirational Photo Booths staff or attendants can not be required or requested
  • Refunds are not available if an event is canceled due to any virus, public health, local, regional, state, national, or global situations.
  • Refunds are not available if the client chooses to not use Inspirational Photo Booths as a result of masking/facial covering, testing, or vaccination request/requirements.

[[accept]] Appropriate Conduct/ Safe Working Environment

  • ​The Client(s) expressly agree(s) to make their best efforts to provide Inspirational Photo Booths and Inspirational Photo Booths staff with safe and appropriate working conditions.
  • In the event of circumstances deemed by either Inspirational Photo Booths or a bystander to present a threat or implied threat of injury or harm to Inspirational Photo Booths staff or equipment, Inspirational Photo Booths reserves the right to cancel all services remaining under this Agreement without any refunds and leave the event.
  • At Inspirational Photo Booths’ discretion, Inspirational Photo Booths may enact a three-strike policy.
    • After the first offense, Inspirational Photo Booths will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), Inspirational Photo Booths shall resume work in accordance with the original terms of this Agreement.
    • If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event.
    • If the behavior occurs a third time, Inspirational Photo Booths will immediately leave the event with no refunds provided.
  • ​If Inspirational Photo Booths leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold Inspirational Photo Booths harmless as a result of incomplete event coverage, or for a lapse in the quality of Inspirational Photo Booths work, and the Client(s) shall be responsible for payment in full.

[[accept]]​ Internet Access

  • In order for instant sharing features such as texting and emailing to work, our equipment requires internet access.
  • Client should provide stable Wi-Fi with internet if they expect these features to function properly.

Legalese Portion of Contract

CONTRACTED PACKAGE

Includes all services described on the invoice that was distributed to and reviewed by the client. Any additional services/products requested by the client incurred by Inspirational Photo Booths will be billed directly to the client. No services contracted can be deducted, but additional services can be added.

For your convenience, payments to Inspirational Photo Booths can be made through your client portal.

SERVICE PERIOD

Pursuant to the responsibilities of the Client, Inspirational Photo Booths agrees to have a photo booth operational for a minimum of 75% during this period. The client understands that occasionally, operations may need to be interrupted for maintenance of the photo booth.

OPERATIONAL DEFINITION

An operational photo booth is defined as the ability to take photos. The inability to print or send digital images does not count against operation time. If the freestanding unit is unable to take photos, we may opt to use a camera, including a cell phone, to take session photos, then after the event make the captured images available as part of the photo gallery.

BOOKING FEE AND PAYMENT

An initial non-refundable booking fee and a signed contract are required to secure your event. The total service fee must be paid in full prior to any services being performed by Inspirational Photo Booths.

A 50% non-refundable booking fee is due upon signing this agreement unless noted otherwise in the above line. The remaining balance is due no later than thirty (30) days before the Client’s event is scheduled to occur. If paying by credit card, the Client agrees to have Inspirational Photo Booths charge the Client’s credit card for payment of services. The Client is liable for any additional time they request at the event at the current hourly rate, which will be billed in 30 minute increments. The Client agrees that in addition to any and all other legal rights and remedies Inspirational Photo Booths may have, the Client will pay a $150 fee for any and all returned checks which Client may write to Inspirational Photo Booths as payment for services.

Inspirational Photo Booths does NOT charge a deposit or retainer fee. We charge a non-refundable booking fee and our service fees. There are NO deposit or retainer fees that can be returned and all requests will be rejected. If a deposit or retainer fee is mentioned anywhere (including partner sites we might work with), it is referring to our non-refundable booking fee.

CHANGES AND CANCELLATIONS

If the event is canceled, no portion of the fees paid to Inspirational Photo Booths will be returned.

Any request for a date, time, or location change must be made in writing at least thirty (30) days in advance of the original event date. Change is subject to photo booth availability, staff availability, and receipt of a new Service Contract. If there is no availability for the alternate date, time, or location, the booking fee shall be forfeited and the event canceled. Any cancellation occurring less than thirty (30) days prior to the event date shall forfeit all payments made and the client may be responsible for any balances owed.

Inspirational Photo Booths reserves the right to charge a rebooking fee or higher rates for any events that are rescheduled.

Inspirational Photo Booths reserves the right to cancel discounted events if approached by a prospective full-price client. The procedure for this will vary and you will be notified of options.

Inspirational Photo Booths reserves the right to cancel short events if approached by a prospective client who wants a longer time that conflicts with your event. The procedure for this will vary and you will be notified of options.

WEATHER-RELATED CANCELLATIONS

Inspirational Photo Booths is not liable for any cancellations due to weather. If a government entity declares a weather-related emergency that causes the event to be canceled or prevents us from attending, Inspirational Photo Booths will work with the Client on rescheduling, but reserves the right to keep any booking fees and charge according to our standard cancellation policy.

RESPONSIBILITY

Inspirational Photo Booths is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the Inspirational Photo Booths, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In a situation where Inspirational Photo Booths is unable to provide services, Inspirational Photo Booths will attempt to obtain a qualified professional replacement to fulfill Inspirational Photo Booths obligations under the contract, at no additional charge to the client.

At times Inspirational Photo Booths will use other qualified professionals that may not be part of our normal staff when demand is high and our staff is unable to handle the volume.

ACCESS

The Client will arrange for an appropriate space for the photo booth at the Client’s venue. Space must be at least 20’ by 20′ and 10’ in height, on a level surface, on solid ground, under a covering, and against a wall to protect the equipment from wind, rain, and poor lighting. It is the Client’s responsibility to ensure access is possible. The Client is responsible for providing power to the photo booth with 15ft. access to a working outlet (3 prong, 110V, 10 amps). If a working outlet is not where we are set up, the client is responsible for ensuring no one trips on extension cords.

If the ceiling is under 10 feet high, we may not be able to provide a background. The client is responsible for any ceiling damage if sufficient height is not provided.

Inspirational Photo Booths reserves the right to cancel the service if minimum space can not be provided. This will result in forfeiture of any fees charged for the service.

The client must provide access to space a minimum of two (2) hours prior to the scheduled start time. Failure to may result in the inability to have the booth fully operational prior to the scheduled start time. If this causes a delayed start, delayed start time does not count as downtime.

Events must be on the ground floor, or an elevator must be provided. Inspirational Photo Booths reserves the right to cancel and leave with no refunds if the condition is not met.

If the venue requires vendors to provide any insurance coverage documents, a written request must be received by Inspirational Photo Booths a minimum of five (5) business days (Monday through Friday, not including holidays) before the event.

PHOTO RELEASES

Client grants Inspirational Photo Booths permission to use images from Client’s event to promote our business, including but not limited to, use on our website, blog, social media, and print and digital marketing materials. The client waives any right to any payment, royalties, or any other consideration for the use of the images. The client waives the right to inspect or approve the finished product, including a written or electronic copy, wherein the Client’s likeness appears. Client hereby holds harmless, releases, and forever discharges us from all claims, demands, and causes of action which Client, his/her heirs, representatives, executors, administrators, or any other persons acting on Client’s behalf or on behalf of the Client’s estates have or may have by reason of this authorization.

PHOTO COPYRIGHT

All images come with a limited personal/internal usage copyright. No images can be used for commercial purposes without being licensed through Chaney Inspirations LLC / Inspirational Photo Booths. They may be used in a normal post that is NOT boosted and NOT used as a marketing tool. Images may not be used in any marketing materials.

PHOTO USAGE/LICENSING

License is for digital personal/internal usage of images only. Print and commercial usage rights are available for licensing for an additional fee.

No images can be used for commercial purposes without being licensed through Chaney Inspirations LLC / Inspirational Photo Booths.

The client is provided with “source” images (images used to create the framed images) as a courtesy to be available for personal/internal usage but is prohibited from distributing the images or having individual images printed without purchasing the rights from Chaney Inspirations LLC / Inspirational Photo Booths.

ONLINE GALLERY

If the Client has ordered access to an online gallery, upon receiving a link to the files, the Client accepts all responsibility for archiving and protecting the photographs and media. Inspirational Photo Booths is not responsible for the lifespan of any digital media provided for any future changes in digital technology or media readers that might result in the inability to read the discs provided. It is the Client’s responsibility to make sure that digital files are copied to new media as required. Digital image files will only be made available for download in an online gallery for up to 30 days.

LIABILITY

It is understood that Inspirational Photo Booths is only liable for services completed and provided by Inspirational Photo Booths and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Inspirational Photo Booths be liable for consequential damages of any kind.

HOLD HARMLESS

At all times after the effective date of this Agreement, the Parties shall indemnify each other and their officers, members, managers, employees, owners, sublicensees, affiliates, subsidiaries, successors, and assigns (collectively, the “Indemnitees”) from all damages, liabilities, expenses, claims, or judgments (including interest, penalties, reasonable attorneys’ fees, accounting fees, and expert witness fees) (collectively, the “Claims”) that any Indemnitee may incur and that arise from:

(a) A Parties’ gross negligence or willful misconduct arising from the Party’s carrying out of its obligations under this Agreement;

(b) Any breach of any of its obligations or representations under this Agreement.

Additionally, the Client will indemnify Inspirational Photo Booths from any claim or cause of action arising out of or relating to any event, product, promotion, etc. that is the subject of this or a related agreement, including, but not limited to, any claim or cause of action by an attendee of Client’s event against Inspirational Photo Booths or any damage caused to Inspirational Photo Booths equipment or personnel caused by Client or one of Client’s event attendees.

PHOTO TEMPLATES

Inspirational Photo Booths personalized photo templates are customized for each client and may be revised up to two (2) times without incurring a design fee. Inspirational Photo Booths creates custom photo templates using information directly from the Client’s form. If the Client’s form is not filled out Inspirational Photo Booths will provide a generic template at your event. Graphics such as logos or monograms can be added if provided by the Client thirty (30) days before the event.

Inspirational Photo Booths reserves the right to place their logo, websites, social media, hashtags, or any other materials on photo templates.

In the event client requests no branding on the photo template, a fee of at least fifty percent (50%) of the non-discounted quoted price applies.

The client acknowledges they have the legal right and/or required license(s) to use any images, logos, or other materials provided. The client understands they can not just “grab” images from Google or any other website and use them as their own.

  • Client understands websites such as Etsy have sellers that sell items they do not have the right to sell and without proper licensing, regardless of source, can not be used.

WIFI

Inspirational Photo Booth’s instant sharing features require Client to provide access to or guarantee a venue internet connection. Inspirational Photo Booths is not responsible for insufficient image sharing features if sufficient internet access is not provided.

OUTDOOR EVENTS

The client must provide appropriate shelter and power for outdoor events. Client-provided generators are prohibited as power sources. Inspirational Photo Booths may make shelters and generators available for additional fees.

The client is responsible for any damage to Inspirational Photo Booths equipment as a result of failure to provide appropriate shelter, including and not limited to water and electrical damage.

Equipment and backgrounds can not be in direct sunlight. If equipment malfunctions as a result of the sun or environment, Inspirational Photo Booths reserves the right to cancel and leave with no refunds.

If there is bad weather and appropriate safe space is not provided, Inspirational Photo Booths reserves the right to cancel and leave with no refunds.

The environment must be pest-free.

If the outside temperature is above 80 degrees Fahrenheit, equipment may not function properly, in which case the client must provide a cooler indoor space or Inspirational Photo Booths reserves the right to cancel and leave with no refunds.

Smoking is prohibited in and around the photo booth area (applies regardless of location).

MISCELLANEOUS TERMS

In the event Inspirational Photo Booths is unable to supply a working photo booth for at least 75% of the service period, the Client shall be refunded a prorated amount based on the amount of service received upon written request. If no service is received, Inspirational Photo Booths maximum liability will be the return of all payments received from the Client. Inspirational Photo Booths is not responsible for any consequential damages or lost opportunities upon breach of this Agreement.

PROVIDED DOCUMENTATION

All documentation and images created and provided to the client are owned and copywritten by Chaney Inspirations LLC/Inspirational Photo Booths and cannot be used or given to any other 3rd party.

ADDITIONAL COST

This contract is not inclusive of all costs related to services provided by Inspirational Photo Booths. This contract establishes the relationship, expectations, and base cost. The client will be billed for any additional services they request or costs that are incurred needed to fulfill their request, including and not limited to supplies, custom materials, hotel fees, and parking fees.

HOTEL ACCOMMODATIONS

Hotel accommodations (1 room with 2 queen or larger beds for 2 days or 2 rooms with 1 queen or larger bed for 2 days for every 2 employees) are required within 10 – 15 miles of the site in a safe location for all staff of Inspirational Photo Booths working the events for any events located further than 40 miles from New Braunfels Texas.

Hotel accommodations should be made for the night before to allow for travel in and the day of to allow employees to rest after the event before traveling.

Inspirational Photo Booths reserves the right to book their own accommodations and bill client.

TRAVEL

For all events deemed as destination (taking place beyond 50 miles from home base), additional fees are applicable, such as round trip airfare, hotel stay for 4-5 days & 3-4 nights pending complexity, and car rentals from the airport and back during the stay. All travel can be arranged by clients per specifications of Inspirational Photo Booths or arranged by Inspirational Photo Booths with the agreement of payment invoiced.

PARKING

The Client shall provide safe parking for the Inspirational Photo Booths attendant’s vehicle while at the Client’s event. If parking is not provided, the Client agrees to have their card charged for the amount of parking cost incurred.

FOOD

If food is provided at the event, the Client is required to make it available, including dessert, to attendants. Unless otherwise noted, food must be available for up to 3 attendants. If a choice is required to be made in advance, please notify Inspirational Photo Booths with options.

The client is to provide unlimited soft drinks to Inspirational Photo Booth staff at no charge.

CLIENT PROVIDED ITEMS

The client is to provide:

  • Flat cart to transport equipment
  • Minimum of 2 chairs
  • At least one table six (Six) feet or longer
  • Bench or something guest may sit on when in booth

IDLE TIME

If the Client requests set up by a certain time and a later start time, a minimum fee of $150 per hour for “Idle Time” will be invoiced.

HEALTH/COVID

An inherent risk of exposure to Coronavirus/COVID-19/Flu/Illness exists in any public place where people gather. Inspirational Photo Booths can not be held liable for any claims of exposure at any events.

Masking/facial covering, testing, vaccination, or status of vaccination or test results of Inspirational Photo Booths staff or attendants can not be required or requested

Refunds are not available if an event is canceled due to any virus, public health, local, regional, state, national, or global situations.

Refunds are not available if the client chooses to not use Inspirational Photo Booths as a result of masking/facial covering, testing, or vaccination request/requirements.

EVENT INSURANCE

Inspirational Photo Booths recommends clients obtain event insurance. Inspirational Photo Booths only refunds if we cancel. If canceled for another reason, Inspirational Photo Booths retains the right to deny refund requests.

DAMAGE TO EQUIPMENT

The client acknowledges that they shall be responsible for any damage or loss to the Inspirational Photo Booths Equipment caused by: a) Any misuse of Inspirational Photo Booths Equipment by the Client or its guests, or b) Any theft or disaster (including but not limited to fire, flood or earthquake).

Inspirational Photo Booths reserves the right to charge for excessive missing props.

APPROPRIATE CONDUCT/SAFE WORKING ENVIRONMENT

The Client(s) expressly agree(s) to take their best efforts to provide Inspirational Photo Booths and Inspirational Photo Booths staff with safe and appropriate working conditions.

In the event of circumstances deemed by either Inspirational Photo Booths or a bystander to present a threat or implied threat of injury or harm to Inspirational Photo Booths staff or equipment, Inspirational Photo Booths reserves the right to cancel all services remaining under this Agreement and leave the event.

SEVERABILITY

If any one or more of the provisions contained in this Agreement is, for any reason, held to be invalid, illegal, or unenforceable in any respect, that invalidity, illegality, or unenforceability will not affect any other provisions of this Agreement, but this Agreement will be construed as if those invalid, illegal, or unenforceable provisions had never been contained in it, unless the deletion of those provisions would result in such a material change so as to cause completion of the transactions contemplated by this Agreement to be unreasonable.

WAIVER

No waiver of a breach, failure of any condition, or any right or remedy contained in or granted by the provisions of this Agreement will be effective unless it is in writing and signed by the Party waiving the breach, failure, right, or remedy. No waiver of any breach, failure, right, or remedy will be deemed a waiver of any other breach, failure, right, or remedy, whether or not similar, and no waiver will constitute a continuing waiver, unless the writing so specifies.

ENTIRE AGREEMENT

This Agreement constitutes the final agreement of the Parties. It is the complete and exclusive expression of the Parties’ Agreement with respect to the subject matter of this Agreement. All prior and contemporaneous communications, negotiations, and Agreements between the Parties relating to the subject matter of this Agreement are expressly merged into and superseded by this Agreement. The provisions of this Agreement may not be explained, supplemented, or qualified by evidence of trade usage or a prior course of dealings. Neither Party was induced to enter this Agreement by, and neither Party is relying on, any statement, representation, warranty, or Agreement of the other Party except those set forth expressly in this Agreement. Except as set forth expressly in this Agreement, there are no conditions precedent to this Agreement’s effectiveness.

FORCE MAJEURE

A Party will not be in breach of or in default under this Agreement on account of, and will not be liable to the other Party for, any delay or failure to perform its obligations under this Agreement by reason of fire, earthquake, flood, explosion, strike, riot, war, terrorism, or similar event beyond that Party’s reasonable control (each a “Force Majeure Event”). However, if a Force Majeure Event occurs, the affected Party shall, as soon as practicable:

(a) notify the other Party of the Force Majeure Event and its impact on performance under this Agreement; and

(b) use reasonable efforts to resolve any issues resulting from the Force Majeure Event and perform its obligations under this Agreement.

GOVERNING LAW

(a) Choice of Law. This Agreement shall be construed under the laws of the State of Texas, without regard to its choice or conflict of law principles.

(b) Choice of Forum. Mediation is required before any claims can be taken to any court. Any claim or cause of action arising out of or related to this Agreement shall be brought in a court of competent jurisdiction in Comal County, State of Texas, or the United States District Court for the District of Texas.

(c) Attorneys’ Fees. If either Party employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing Party shall be entitled to its reasonable attorneys’ fees and costs.

ALL SALES ARE FINAL
The Client understands and agrees that all sales and service fees are final.

The signing parties acknowledge they have the legal right to enter into the contract and have received any required approvals from any departments including the accounting department or whoever is in charge of issuing payment.

Each Party is signing this Agreement on the date stated opposite that Party’s signature.
